A federal appeals court on Thursday night declined to block the Justice Department’s release of special counsel Jack Smith’s final report on President-elect Donald Trump’s alleged efforts to overturn the results of the 2020 election.

Trump has asked the Supreme Court to block the entire release of the report, which would also include a portion about the classified documents case, but the Supreme Court has not issued its ruling so far.

The 11th Circuit Court of Appeals rejected Trump’s attempt to block the release, according to the Washington Post, but allowed a three-day injunction from Judge Aileen Cannon to remain in place. 

Cannon approved the emergency injunction on Tuesday, and set it for three days after the Appeals Court releases its ruling. This will give Trump’s legal team time to further appeal the ruling, and delay the publication until after Smith and Attorney General Merrick Garland leave office, when Trump is sworn in on Jan. 20.

Garland said he will not release the part of the two-volume report that centers on the classified documents case.
