Pennsylvania Republican Senate candidate Dave McCormick filed two lawsuits, challenging provisional ballots in Philadelphia, potentially taking the case to the Supreme Court.

The Associated Press on Thursday declared McCormick the winner over Democratic incumbent Sen. Bob Casey.

McCormick’s attorneys said that Philadelphia would adjudicate thousands of provisional ballots and asked to challenge them in groups instead of individually. The campaign alleged “large groups” of the ballots don’t comply with statutory requirements, according to The Hill.

“Plaintiff is concerned that the sheer number of provisional ballots will overwhelm the capacity for individual challenges, creating an impractical burden that risks errors or inconsistencies in the adjudication process,” McCormick’s lawyers stated.

As of press time, the Philadelphia Board of Elections has not responded to the lawsuit.

McCormick previously ran for Senate in the 2022 primary, but lost out to the Trump-endorsed Dr. Mehmet Oz, who went on to lose to then-Lt. Gov. John Fetterman, D-Pa.
