Special Counsel Jack Smith, who brought two federal cases against former and future President Donald Trump but walks away with zero victories, has resigned from the Department of Justice.

The move is not unexpected, as Smith had indicated previously that he would take off before Trump could can him.

On Thursday, the 11th Circuit ruled that he could release part of his report on his investigations. RedState’s Joe Cunningham wrote:
Smith’s report primarily addresses Trump’s alleged efforts to challenge the 2020 election results, but it also includes a section on the Mar-a-Lago classified documents case—a case Judge Aileen Cannon dismissed last year. Cannon initially ordered the release be put on hold pending further legal proceedings. The 11th Circuit ruled, however, that the report could be released.
Missouri Senator Eric Schmitt (R) blasted the special counsel and his failed weaponization of the legal system:
🚨BREAKING: Jack Smith resigns from the Department of Justice.
Jack Smith was brought in to do one thing — put Trump in jail for the rest of his life thus preventing him from becoming President again. That’s it.
He failed.

President Trump fought back and defiantly stood up to the Lawfare and WON.
The American people rendered their verdict on November 5th.
The Democrats were willing to turn our country into a banana republic. The weaponized DOJ was the real Threat to Democracy™️.
Thankfully, the American people rejected their lies and Lawfare.
That’s part of what it meant to Save America in 2024.
The republic survives and we now have an opportunity for a great renewal. [American flag emoji]
The complicated cases—one involving election subversion interference and the other regarding classified documents—have dragged on endlessly, with litigation ending up in multiple courtrooms as the Trump team fought the charges. Read our full coverage here.

Jack Smith’s Election Interference Case Against Donald Trump Is Officially Toast (Updated)
George Washington University Law Professor and frequent pundit Jonathan Turley, writing earlier Saturday before the resignation was revealed, said Smith only had to look in the mirror to find who to blame for his failures:
The expected release of Special Counsel Jack Smith’s report will occur as early as this weekend, albeit without those sections dealing with the Florida documents case. (Other defendants are still facing prosecution in that case.) However, the most glaring omission will be arguably an explanation of how Smith lost this war without firing a single shot in a trial.
After more than two years, two separate cases and countless appeals (not to mention more than $50 million spent), Smith left without presenting a single witness, let alone charge, at trial. It is an example of how a general can have the largest army and unlimited resources and yet defeat himself with a series of miscalculations.
History probably won’t be kind to Smith, whose record bespeaks a “parade general” — a prosecutor who offered more pretense than progress in the prosecution of an American president.

Goodbye, Jack Smith. The only real question remaining is if Trump’s DOJ will investigate any potential abuses by the departing special counsel. We shall see.
