The latest move in the president-elect’s hush money case, falling days before his inauguration, found the “illegitimate political attack” blasted as a “Rigged Charade.”
As Special Counsel Jack Smith wound down his federal cases against President-elect Donald Trump and Fulton County District Attorney Fani Willis was disqualified from prosecuting alleged election interference in Georgia, the New York case persisted. Having previously delayed the case in the wake of the election results to hear arguments on the path forward, New York Judge Juan Merchan announced a Jan. 10 sentencing date Friday, prompting the GOP leader to unload on the “radical partisan.”
“Every Legal Scholar and Pundit, including the highly respected, and sadly recently passed, David Rivkin, as well as Jonathan Turley, Elie Honig, Andy McCarthy, Alan Dershowitz, Gregg Jarrett, Elizabeth Price Foley, Katie and Andy Cherkasky, Paul Ingrassia, and many others, have unequivocally stated that the Manhattan D.A.’s Witch Hunt is a nonexistent case, which is not based by the Statute of Limitations but, on the merits, should never have been brought,” began Trump, who had been convicted on 34 felony counts of falsifying business records in May.
“This illegitimate political attack is nothing but a Rigged Charade,” he continued. “‘Acting’ Justice Merchan, who is a radical partisan, just issued another order that is knowingly unlawful, goes against our Constitution and, if allowed to stand, would be the end of the Presidency as we know it.”
The president-elect further criticized the standing gag order, which the Supreme Court had declined to lift, and restricted Trump’s ability to comment on the family members of Merchan and Manhattan District Attorney Alving Bragg.
“Merchan has so little respect for the Constitution that he is keeping in place an illegal gag order on me, your President and President Elect, just so I cannot expose his and his family’s disqualifying and illegal conflicts,” wrote Trump. “I am the only Political Opponent in American History not allowed to defend myself — A despicable First Amendment Violation!”
In a separate reaction to the sentencing announcement, White House communications director designee Steven Cheung had said in part, “Today’s order by the deeply conflicted, Acting Justice Merchan in the Manhattan DA Witch Hunt is a direct violation of the Supreme Court’s Immunity decision and other longstanding jurisprudence.”
The ruling itself had Merchan determining, “Finding no legal impediment to sentencing and recognizing that Presidential immunity will likely attach once Defendant takes his Oath of Office, it is incumbent upon this Court to set this matter down for the imposition of sentence prior to January 20, 2025.”
“It is this Court’s firm belief that only by bringing finality on this matter will all three interests be served,” the judge added while an “unconditional discharge” was his stated sentencing inclination with consideration of presidential immunity, clearing the path for Trump to pursue an appeal.
“They want to see if they can get a pound of flesh because every case has failed,” Trump had said in part to Fox News Digital while he had continued on Truth Social, “Merchan took the Bragg Hoax that, according to all Legal Scholars, should have been dead on arrival and, through his fraud and misconduct, gave it a semblance of ‘life.’”
“While Deranged Jack Smith was ‘sent packing’ back to The Hague, after losing all of his politically manufactured cases against me, Merchan, who is far worse and even more corrupt than Smith in his fight for my hopeless Political Opponents, just cannot let go of this charade,” added the president-elect before alluding to the judge’s daughter’s work consulting for Democratic clients. “Is it because of his conflicts and relations that he keeps breaking the Law? This has to stop! It is time to end the Lawfare once and for all, so we can come together as one Nation and, MAKE AMERICA GREAT AGAIN!”
