Texas prosecutors are seeking the maximum penalty for the men who molested and murdered 12-year-old Jocelyn Nungaray.

In an interview on Fox and Friends on Friday, Harris County District Attorney Kim Ogg confirmed she would be requesting the death penalty for 26-year-old Franklin Pena and 22-year-old Johan Martinez-Rangel, both of whom had entered the country illegally.

“We’ll be filing notice by the state of Texas that we intend to seek the death penalty against Jocelyn’s murderers,” said Ogg, who is an elected Democrat.

“We are seeking death because we want the message out there, that regardless of who you are, but especially if you are illegally in this country, that you will face the same consequences as anyone else for murdering a child during the course of raping and kidnapping her,” she continued.

Ogg added that she had spoken with Jocelyn’s family, who gave their blessing to the decision.

“We feel that a Texas jury will sentence these two defendants, based on the evidence we have, to death,” she explained. “So we’re giving notice today to the defense and the court that that’s our intention.”

“These types of horrific crimes committed by illegal immigrants crossing our border have to stop,” Ogg continued. “The family of Jocelyn is in a position that they never dreamed would happen to them.”

“And I think it’s unfair for anybody with children to be subject to criminals committing horrific crimes that don’t have to happen.”

The two men were apprehended at the southern border back in March and were released with a Notice to Appear (NTA) to have their case heard by an immigration judge at an unspecified date.

Rangel is also the son of an official for Nicolas Maduro’s socialist dictatorship in Venezuela and may also have had links to the transnational gang Tren de Aragua.

Jocelyn’s mother Alexis appeared in an ad for the Trump campaign in the run-up to last month’s presidential election, where she accused Kamala Harris of failing her daughter by refusing to secure the southern borrder.

She said at the time:

Kamala Harris was in charge of immigration in our borders. If we had better border policies and not open borders and not these catch and release policies, I truly believe this all could have been prevented.

Under her being vice president of this country, my daughter’s life was ripped away from her. She had her entire life ahead of her. My daughter is six feet in the ground based off of policies that she allowed to keep. Kamala Harris did have one job and she not only failed, not me, she failed my daughter. She failed Jocelyn and she was only 12.

While Harris was eventually defeated by a landslide, Jocelyn’s family are still waiting for justice. When these animals are sentenced, we can only hope they may find some closure from this horrific tragedy.
