Daniel Penny and his legal team celebrated his acquittal on Monday after the jury in his chokehold trial found him “Not Guilty” of criminally negligent homicide in the death of Jordan Neely.

According to The New York Post, Penny, 26, was spotted having a drink with his defense lawyers Thomas Kenniff and Steven Raiser at Stone Street Tavern in the Financial District hours after the verdict.

Penny faced up to four years behind bars if convicted.

“He’ll be looking to resume, get his life back together,” Kenniff said. “The situation like this, we savor the victory but all the harm that has been done to him just doesn’t vanish. That’s true of anyone who is falsely accused.”

Meanwhile, anti-Penny protesters erupted outside of the courtroom shortly after the verdict was announced, chanting “No Justice, No Peace.”

Penny’s manslaughter charge was dismissed last week by the judge overseeing the case after the jury failed to return a verdict — twice.

“Daniel Penny’s actions were heroic & protected the lives of people on that train,” House Speaker Mike Johnson wrote on X at the time.

“We used to celebrate bravery like this in America, but the Left continues their crusade to protect criminals and prosecute heroes,” Johnson said. “Good to see this charge dismissed.”
