Sen. Roger Marshall, R-Kan., introduced legislation on Wednesday that would federally ban mutilating transgender procedures for children and punish so-called “physicians” who perform such procedures.
The legislation would block doctors from being able to prescribe or administer puberty blockers and cross-sex hormones, as well as perform mutilating transgender surgeries like mastectomies.
The Safeguarding the Overall Protection of Minors (STOP) Act would allow the Department of Health and Human Services to place a minimum $100,000 fine on doctors who do not follow the law. It would also create a private right of action for victims of the procedures — or their guardians if the victim is still a minor — to sue “individuals responsible for performing, attempting to perform, conspiring to perform, or providing a referral for any gender transition procedure on the minor,” according to a Wednesday press release announcing the bill’s introduction.
“Americans resoundingly rejected the Left’s dangerous transgender agenda. Let’s call it exactly what it is: child abuse,” Marshall said in the press release. “The days of demented doctors and activists getting rich off of mutilating, sterilizing, and castrating children are over.”
“Our legislation keeps children’s safety paramount by prohibiting anyone from performing, facilitating, or even conspiring to give these irreversible therapies and procedures to minors,” he added. “This bill is just the beginning of what’s to come with President Trump at the helm and our unwavering commitment to protecting children from transgender activists’ twisted and criminal agenda.”
Marshall, who was an OB-GYN for over two decades, has been laying out congressional Republicans’ agenda on transgender issues in recent weeks. He also previously introduced a bill to officially legally define “male” and “female” in alignment with biological reality instead of allowing Democrats to warp the categories like the Biden administration did with Title IX in redefining sex.
According to the Wednesday press release, the STOP Act is a “major pillar in Senator Marshall’s fight against the transgender industrial complex that is preying on America’s children.”
The transgender medical industry is reportedly worth about $4.5 billion, and, as American Principles Project Terry Schilling suggested last month, aims to “transition all 1.3 million Americans who identify as trans.”
“They want to grow that 1.3 number, too,” he said. “That’s what the whole trans ideology in schools is about … They’ve literally weaponized our tax dollars in our schools to brainwash our kids and get them into this very lucrative pipeline.”
Speaking with Newsmax earlier this week, Marshall said getting the STOP Act across the finish line will be an “uphill battle.” The bill would require 60 votes in the Senate to pass, he told the outlet. Republicans are projected to only hold 53 seats in the new Congress.
Marshall’s legislation comes as Tennessee defended a similar state-level law in the U.S. Supreme Court on Wednesday.
During oral arguments in that case, Justice Samuel Alito dismantled the claim that so-called “gender affirming treatment” including puberty blockers and hormones “improves the physical, psychological well being of transgender adolescents with gender dysphoria.” Alito cited extensive research stating that the risks of such medical interventions are “likely to outweigh” any benefits.
