Steve thinks liberals may be hoisting the white flag on immigration, but I don’t know: some of them seem to be awfully dug in.

Take Denver’s Mayor Mike Johnston. Johnston said that he was willing to deploy the Denver Police Department to stop federal agents from deporting illegal aliens from his city, a clear act of insurrection. He has backed off that position to some degree, but still intends to encourage civil disobedience to prevent the enforcement of federal law, and says he is willing to go to prison in order to secure the ongoing violation of federal law:

A consummation devoutly to be wished! But isn’t even Johnston’s revised position rather insurrection-y? The central charge against most of the January 6 protesters was that they interfered with an official federal proceeding. What Johnston is talking about is not exactly the same, but is certainly analogous–interfering with the enforcement of federal laws.

Thus, 18 U.S. Code § 111 makes it a felony whenever someone:

(1) forcibly assaults, resists, opposes, impedes, intimidates, or interferes with any person designated in section 1114 of this title while engaged in or on account of the performance of official duties….

Section 1114 designates:

…any officer or employee of the United States or of any agency in any branch of the United States Government (including any member of the uniformed services) while such officer or employee is engaged in or on account of the performance of official duties, or any person assisting such an officer or employee in the performance of such duties or on account of that assistance….

Forcible resistance, opposition to, or interference with federal agents is punishable by up to eight years in prison.

Mayor Johnston and other Democrats have clearly announced their intent to interfere with, oppose, and prevent the execution of, federal law. Such opposition can only be effective if City of Denver employees, or citizens encouraged by Johnston, take to the streets to interfere forcibly. If they stand by, observe, and do not impede federal agents, they will be acting legally. But if they actively interfere, e.g. by having “physical contact” with federal agents as described in § 111, they will commit a felony making them liable to eight years imprisonment. No wonder Johnston says he is willing to go to jail. That could well be his fate.

Taking care that the federal laws be faithfully executed–including, obviously, our immigration laws–is the core constitutional duty of the President of the United States under Article II, and preventing federal laws from being executed is the essence of insurrection. It is remarkable how quickly the Democrats shifted from loyal (even fanatical) upholders of federal power into insurrectionists. All it took was a change in administrations.
