Fulton County District Attorney Fani Willis, who has been prosecuting former President Donald Trump in Georgia, just got slapped with a subpoena.

The subpoena was issued by the Republican-dominated Senate Special Committee on Investigations and the district attorney has challenged it, The Atlanta Journal-Constitution reported.

The issue is whether or not the Senate has the authority to force her to testify as it pertains to her investigation into the former president.

Former Gov. Roy Barnes, the personal attorney for Willis, is presenting her case and contends that the Senate does not have that authority.

But Republican State Sen. Bill Cowsert said he believes that the chamber does have that authority.

“The legislative branch has the inherent power to investigate and to utilize subpoenas,” he said.

The committee was established this year when the former president and some of his codefendants sought to have the district attorney removed from the case because of her affair with top prosecutor Nathan Wade.

The district attorney and Wade have maintained that their relationship has ended but this week video footage from a police bodycam showed the two arriving at the scene where her daughter was arrested during a traffic stop.

According to a report from the Daily Mail, Willis was stopped in Tyrone, Ga., on August 24 for using her cell phone while driving. During the stop, police discovered her license had been revoked.

Willis, a student at Texas Southern University, is also reportedly pregnant. Her mother is leading the prosecution in the case against former President Donald Trump related to the 2020 Georgia election interference, the New York Post noted.

She told an officer that she had been using her cellphone “due to her mother calling her related to her pregnancy,” the report said. Kinaya also told officers that she was “unaware” that her license had been revoked since May 13, the report added.

Following her daughter’s arrest, Fani Willis arrived to pick up Kinaya’s 2010 Nissan Altima. “Willis’s mother later arrived on scene to take possession of her vehicle,” DailyMail.com reported.

Kinaya was booked at Fayette County Jail on a misdemeanor charge of driving with a revoked or suspended license. After having her mugshot taken, she was released from the facility, which is located about 30 minutes south of her mother’s office in Atlanta.

She is scheduled for an arraignment on October 24 in Tyrone Municipal Court. If convicted, Kinaya could face a minimum of two days in jail, a $500 fine, and a six-month extension of her license suspension.

Willis’ extensive racketeering case against Trump has been on hold since June as the Georgia Court of Appeals reviews Trump’s attempt to disqualify the 52-year-old district attorney.

In March, Trump and eight co-defendants requested that the appeals court consider their claims of prosecutorial misconduct, alleging issues related to Willis’ relationship with former special prosecutor Nathan Wade.

Fulton County Judge Scott McAfee had earlier ruled that District Attorney Willis could continue with the case provided her former lover, Nathan Wade, stepped down, which he did.

Trump’s appeal aims to overturn McAfee’s decision before the trial begins. The appeals court is expected to hear arguments on the disqualification effort in December, which will be after the November 5 presidential election.

Since securing the grand jury indictment against Trump and 18 others last August, Willis has faced multiple investigations by state and federal lawmakers over allegations of misusing taxpayer funds and her relationship with Wade.

Trump and his 13 remaining co-defendants have pleaded not guilty to felony charges accusing them of violating Georgia’s anti-racketeering law in an alleged attempt to overturn the 2020 election results in the state, The Post noted.
