The United States Supreme Court dismissed the writs of certiorari before judgement and vacated the stays related to Moyle v. United States on Thursday.

Litigation Counsel Carolyn McDonnell said, “The decision was fragmented, and even though five Justices dismissed the case, they couldn’t agree on why they did so. Going forward, the Supreme Court will have other opportunities to review this issue, including in the Texas case that challenges the EMTALA abortion mandate.”

Chief Legal Officer and General Counsel Steven H. Aden said, “This is a highly fractured decision. The Court recognized based on representations by the Biden administration that Idaho may continue to enforce its pro-life law, and the rights of pro-life doctors and nurses will be respected in all circumstances as federal law requires. The case will develop further in the lower courts and the Supreme Court seems ready, willing, and able to review the case again once an appropriate factual record based upon the Biden administration’s actual position is developed.”
