The Supreme Court agreed Wednesday to hear a critical abortion pill case. Two cases, FDA v. Alliance for Hippocratic Medicine and Danco Laboratories, L.L.C. v. Alliance for Hippocratic Medicine, have been consolidated before the Court.

The Court’s review will focus on whether the Fifth Circuit Court of Appeals correctly ruled that the 2016 and later revisions to the Risk Evaluation and Mitigation Strategies (REMS) were lawful under the Administrative Procedures Act. Americans United for Life has filed five amicus curiae briefs on behalf of members of Congress throughout litigation, including this most recent brief.

Chief Legal Officer and General Counsel Steven H. Aden said, “As counsel to the courageous and pro-woman members of Congress in the AHM case, Americans United for Life believes the Court’s decision to review this critically important case strongly suggests that the plaintiffs’ arguments will be received favorably by the Court.”

Aden continued, “The expansion of abortion pills for women far beyond the original restrictions imposed by the FDA has been a healthcare disaster for women and has normalized the wholesale destruction of human life. We look forward to working with AHM to make clear to the Court the grave consequences of the FDA’s reckless and scofflaw actions for women’s health and safety and the respect for human life.”
